Welcome to ZNSKAGLVA, ZG.NYC (the “Site”). By accessing, visiting, browsing, using, or attempting to interact with or use any part of this Site or any ZNSKAGLVA services or content (collectively “Service”), you agree to be bound by these Terms of Service (the “Agreement”).
This Agreement may be modified at any time by ZNSKAGLVA by posting the modified Agreement to the Site. Any such modifications shall be effective immediately upon posting unless some other effective date is expressly stated. 1. Ownership.
Throughout this Site and all associated Services, the terms “ZNSKAGLVA,” “we,” “us,” and “our” refer to the brand identity of REDDHOUSE NYC LLC. By using this Site, you acknowledge that all legal agreements, transactions, and liabilities are formed directly with REDDHOUSE NYC LLC.
2. Our Products.
All products are handmade, hand-decorated and may contain small parts, decorative elements, adhesives, and embellishments. Slight variations among products are normal and part of the artistic process. Each product is original and no two product designs are exactly alike. Please note that colors or products’ appearance may differ from how they appear on your screen due to device type, settings, and configuration. We do not warrant that the appearance or quality of a product or Service will meet your expectations or match in appearance as depicted or rendered on our Site.
The products contain small parts which may pose a choking or safety hazard and are not intended for children. We reserve the right to discontinue and/or limit the availability of a product at any time at our discretion.
3. Care and Maintenance.
The products include hand-applied embellishments. Avoid exposure to water, extreme heat, or rough handling. Decorations may loosen over time. If there is a defect with your product above and beyond normal wear and tear, please contact us and we will apply commercially reasonable efforts to rectify the issue. ZNSKAGLVA is not responsible for repairs unless agreed upon under a separate, paid Service.
4. Orders.
By placing an order, you are making an offer to purchase which is not accepted until confirmed by ZNSKAGLVA. We reserve the right to accept or decline your order for any reason at our discretion. In the event we are not able to accept your order, we will attempt to notify you by
contacting the email, billing address and/or phone number provided with the order. Please review your order carefully before submitting as we may not be able to accommodate cancellation requests after an order is accepted. Prices, discounts, and promotions in effect are as displayed on our Site at the time an order is placed and in your confirmation email. Unless otherwise explicitly stated, prices do not include taxes, shipping, handling, customs or import charges. We are not liable for shipping and/or delivery delays. All delivery times are estimates and not guaranteed. You agree to provide current, complete, and accurate purchase, payment and account information for all orders. You represent and warrant that your order is for personal or household use and not for commercial resale or export.
5. Returns & Exchanges.
All sales are final and no refunds will be issued. Returns, refunds, and exchanges are not accepted except in cases involving our error in fulfilling your order. Any and all claims related to order errors must be submitted within seven (7) days from receipt of the product.
6. Privacy. In addition, when using our Site, you shall be subject to any posted policies, guidelines or rules applicable to use of the Site and any service provided by the Site, including, but not limited to, our Privacy Policy. All such policies, guidelines and rules are hereby incorporated by reference into this Agreement.
7. Site Content.
The Site is provided on an “as is” basis and may use internet services that are not under our direct control. While we strive to provide accurate descriptions of our products and services, we do not warrant that the descriptions, pricing, or other content on the Site are accurate, complete, or current. We reserve the right to correct errors and to cancel any orders that were placed using incorrect descriptions or pricing. We do not warrant that the Site or its features will be accessible at all times or that it will function in an error free manner. We reserve the right to cease operating the Site or any of its features at any time.
8. Intellectual Property.
All content on this Site including without limitation graphics, logos,
trademarks, images, and software is, and shall continue to be, the property of ZNSKAGLVA or its content suppliers and is protected under applicable copyright, patent, trademark, and other proprietary rights. Any copying, redistribution, use or publication by you of any such content or any part of the Site is prohibited, except as expressly permitted in this Agreement. Under no circumstances will you acquire any ownership rights or other interest in any content by or through your use of this Site. You further acknowledge and agree that content contained in advertisements or information presented to you through any Service or advertisers is protected by copyright, trademarks, service marks, patents or other proprietary rights and laws.
9. Links to Other Sites.
The Site may provide links to other websites. This Site’s Terms of Service or Privacy Policy may not apply to those other websites, which may have their own terms and policies. You should review the terms of service and privacy policies of any other websites that you visit.
10. Compliance with Laws.
You agree to comply with all applicable laws regarding your use of the Site. You further agree that information provided by you is truthful and accurate to the best of your
knowledge.
11. Indemnification.
You agree to indemnify and hold ZNSKAGLVA, its subsidiaries, affiliates, licensors, content providers, service providers, employees, agents, officers, directors, and contractors
(the "Indemnified Parties") harmless from any breach of this Agreement by you. You agree that the Indemnified Parties will have no liability in connection with any such breach or unauthorized use, and you agree to indemnify any and all resulting loss, damages, judgments, awards, costs, expenses, and attorneys' fees of the Indemnified Parties in connection therewith. You will also indemnify and hold the Indemnified Parties harmless from and against any claims brought by third parties arising out of your use of any content or information or service accessed from this Site.
12. Disclaimer.
THE INFORMATION ON THIS SITE IS PROVIDED ON AN "AS IS," "AS
AVAILABLE" BASIS. YOU AGREE THAT USE OF THIS SITE IS AT YOUR SOLE RISK. ZNSKAGLVA DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY EXPRESS WARRANTIES, STATUTORY WARRANTIES, AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE EXTENT YOUR JURISDICTION DOES NOT ALLOW LIMITATIONS ON WARRANTIES, THIS LIMITATION MAY NOT APPLY TO YOU. YOUR SOLE AND EXCLUSIVE REMEDY RELATING TO YOUR USE OF THE SITE SHALL
BE TO DISCONTINUE USING THE SITE.
13. Limitation of Liability.
UNDER NO CIRCUMSTANCES WILL ZNSKAGLVA BE LIABLE OR RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL (INCLUDING DAMAGES FROM LOSS OF BUSINESS, LOST PROFITS, LITIGATION, OR THE LIKE), SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN ANY WAY RELATING TO THE SITE, YOUR SITE USE, OR THE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR
SOLE REMEDY FOR DISSATISFACTION WITH THE SITE AND/OR CONTENT IS TO CEASE ALL OF YOUR SITE USE.
14. Copyrights and Copyright Agent.
If you believe your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have otherwise been violated, please provide a notice containing all of the following information to our Copyright Agent:
(a) An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
(b) A description of the copyrighted work that you claim has been infringed;
(c) A description of where the material that you claim is infringing is located on the Site;
(d) Your address, telephone number, and e-mail address;
(e) A statement by you that you have a good faith belief that the disputed use is not authorized by
the copyright owner, its agent, or the law; and
(f) A statement by you, made under penalty of perjury, that the above information in your notice is
accurate and that you are the copyright owner or authorized to act on the copyright owner's
behalf.

15. Applicable Law.
You agree that the laws of the state of New York without regard to conflicts of laws
provisions will govern this Agreement and any dispute that may arise between you and ZNSKAGLVA
or its affiliates. Venue shall be the state and federal courts located in New York.
16. Severability.
If any provision of this Agreement shall be adjudged by any court of competent
jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the
minimum extent necessary so that this Agreement will otherwise remain in full force and effect.
17. Relationship of the Parties.
Each party is, and shall remain, an independent contractor and nothing contained in this Agreement shall be construed to make either party a partner, joint venturer, employee or agent of the other party, and neither party shall hold itself out as such. Neither party has any right or authority to incur, assume or create, in writing or otherwise, any warranty, liability or other obligation of any kind, express or implied, in the name of or on behalf of the other party.
